Ladies and Gentlemen of the MRGRG community:

As I embark upon this next great adventure designed to keep the military retiree medical care broken promise issue alive and endeavor to regain the medical care I (we) were promised as a result of fulfilling my (our) part of a contract I will be saying many things that I said often in the past such as... "if we don't keep the military retiree medical care broken promise issue alive by keeping it in the publics eye then it will surely die". The Congress will not ask us what we want we must tell them.

With all that said, I now say let's bring it all back home and make our case in our communities. We have been to the courts, and we have been to the Hill.

We must tell the people in our community what we are going to tell them, tell them, and tell them what we have told them, over, and over, and over..

We must take advantage of the current world situation (the war on terror) such that we help those military retirees that will follow us as well as help ourselves. We must relate our past military retiree medical care broken promise issue to what will surely happen to those men and women that are coming behind us if steps are not taken to correct the military recruiting philosophy. It's wrong to enter into a contract then break that contract.

Without offering a long detailed plan, which will surely be subject to change, I am suggesting that we talk. I am suggesting that we communicate with each other via what I call the MRGRG Record Book. Any entry you make in the Record Book is e-mailed to me automatically and I will see it. Anyone else that wants to see what is happening can go take a look.

A Proclamation by Floyd Sears, MSGT, USAF, retired

WHEREAS, not all veterans are the same, in reference to the medical care that was promised to them at the end of their service to their country; and

WHEREAS, many members of the Congress, their staff members, the news media, and the American people don't realize that there is a difference between a military veteran that spends less than 20 years in the military and is discharged and a military retiree veteran that spends 20 to 30 years in the military and retires; and

WHEREAS, they don't seem to understand that medical care promises were made to both groups, but the promises are different; and

WHEREAS, military retirees were promised free medical care for themselves and their eligible dependents for life at Military Treatment Facilities after their retirement while they were on active duty from WWII to the early 1990's; and

WHEREAS, military veterans were promised medical care at a VA Hospital or Clinic basically for service connected disabilities or medical conditions; and

WHEREAS, some people get confused, concerning this discussion, since a distinction is made between the military veteran and the military retiree; and

WHEREAS, this distinction is necessary to avoid the confusion that always results when military retiree issues are being discussed and the Congress responds by talking about veteran’s issues instead of military retiree issues; and

WHEREAS, the military retiree medical care broken promise issue is not a military veteran's issue, it is a military retiree issue; and

WHEREAS, in fairness to all concerned; the Congress, Congressional Staff Members, the News Media, the American People, all Veterans, and all Veterans Service Organizations, it must be understood that there is a difference between the "military retiree" and the "military veteran" in reference to the medical care that was promised after service to their country; and

WHEREAS, from WWII to the early 1990's, agents of the United States Government made this offer, serve for 20 years in the military and retire, and you will receive free medical care for yourself and your eligible dependents, at military treatment facilities, for as long as you and your eligible dependents live; and

WHEREAS, events have proven that this promise was the greatest gimmick, promotional stratagem, and swindle of all time; and

WHEREAS, the active duty military believed it as they were suppose to; and

WHEREAS, since TITLE 10, Subtitle A, PART II, CHAPTER 55, Section. 1074, (b) of the U.S. Code backed up the promise that was being made; and

WHEREAS, the U. S. Congress altered the U. S. Code such that the promise that had been made was no longer valid by adding the words "subject to the availability of space and facilities and the capabilities of the medical and dental staff"; and

WHEREAS, since the United States Court of Appeals for the Federal Circuit concluded, "We cannot readily imagine more sympathetic plaintiffs than the retired officers of the World War II and Korean War era involved in this case. They served their country for at least 20 years with the understanding that when they retired they and their dependents would receive full free health care for life. The promise of such health care was made in good faith and relied upon. Again, however, because no authority existed to make such promises in the first place, and because Congress has never ratified or acquiesced to this promise, we have no alternative but to uphold the judgment against the retirees' breach-of-contract claim.; and

WHEREAS, the same court has said, "However, if they [military retirees] are to get any relief, it must come from Congress, as this is not within [a court's] jurisdiction; and

WHEREAS, since the Keep Our Promise to America's Military Retirees Act, HR 602, which has 236 cosponsors (well over one half of the House) stays tied up in the Subcommittee on Health, for a period to be subsequently determined by the Chairman. ; and

WHEREAS, since military retirees have no other recourse except to follow the rules of the law of the land;

NOW, THEREFORE, I, Floyd H. Sears, one of many millions that has served the United States of America for more than 20 years during the Korean Conflict and in Viet Nam, hereby proclaim my support of military retirees from the past, the present and the future for as long as I shall live.
