Orlando Garcia, 19, and Alejandro Guana, 17, remain in custody while awaiting arraignment in connection with the shooting death of Tennessee Highway Patrol trooper Calvin Jenks Saturday night.

According to Tipton County Sheriff's Dept. Chief Deputy Clark Dunlap, Garcia is in the Tipton County Jail, while Guana is in juvenile detention in Memphis.

"It will be at least Tuesday before they are arraigned," Dunlap said Monday morning. "No formal charges have been filed as yet."

He said that Garcia would be arraigned in Tipton County Circuit Court in Somerville, while Guana would be arraigned in juvenile court. There was no word on whether authorities would seek to have Guana tried as an adult.

According to the TBI, Jenks stopped the pair near the intersection of highways 14 and 54 in Tipton County, and smelled marijuana on the driver.

He asked if there were drugs in the car, the driver admitted there were in the center console. Jenks then went to the passenger and asked whether he had drugs, the man said he didn't, then shot Jenks twice according to videotape of the incident.

The pair were believed to be bringing drugs from Texas to Tennessee. They abandoned their car, hitched a ride to Nashville where they were arrested on Sunday in a motel near downtown.

Jenks, 24, is the first THP officer to be shot and killed since 1991.
